Workplace rights for cancer patients
You can request shorter working hours, work from home, better working conditions or a transfer to a role that suits your health, as well as information about your employment rights.
Change of working hours

You can ask to switch from full-time to part-time or the other way around. Your employer is required to consider the request. If you work reduced hours, your salary is adjusted accordingly.

Work from home

You and your employer can agree on working from home, fully or partially, whenever the nature of the job allows it.

Better working conditions

Your employer may offer better conditions than the legal minimum through a collective agreement or internal policy – for example, extra remote days, flexible hours or additional benefits.

Transfer to a suitable role

If a doctor determines that your current tasks could affect your health, your employer must try to find you a role suited to your condition and abilities.

Right to information

Your employer must inform you about your working conditions, your rights and obligations, and workplace health and safety rules.

Prohibition of discrimination based on health status

Discrimination against employees and job seekers based on health status or disability is prohibited. Your employer may not put you at a disadvantage in hiring, work, or advancement because of illness.

Prohibition of night, shift, and overtime work

An employee may be prohibited from night, shift, and overtime work if the competent health authority determines that such work could worsen their health condition.

Work according to health condition

An employee with health impairments, as determined by the competent health authority in accordance with the law, may not perform tasks that would cause deterioration of their health or consequences dangerous to their surroundings. The employer is obliged to provide work in accordance with the employee's work capacity, as prescribed by law.

Working hours, remote work, workplace conditions and transfers are regulated by the Labor Act (pravno-informacioni-sistem.rs/eli/rep/sgrs/skupstina/zakon/2005/24/1/reg).

Labor Act

Your rights regarding working hours, remote work, transfers and workplace conditions are set out in the Labor Act. If you work reduced hours, your salary and other earnings are adjusted proportionally.
